Who we are

NeverMissai LLC ("NeverMiss", "we", "us") is based in Long Beach, California. You can reach us at Liamhawke2006@gmail.com or (562) 620-3988.

Who can use the site

The site is for business owners and the people who work with them. You must be at least 18 to use it. If you enter information about a business, you confirm you are allowed to share it.

The Leak Report is an estimate

The figure in your Leak Report is an estimate. We build it from the numbers you enter and a planning assumption about how much of that leak could be won back. It is not a measured result, a quote, a promise of results or a guarantee.

The Leak Report is not financial, accounting, tax or legal advice. Your results will vary. Make business decisions on your own judgment and, where you need it, with your own advisers.

We don't guarantee any particular number of bookings, revenue or business result from any system we build or run.

Tony and other AI features

Tony is NeverMiss's AI voice assistant. Tony is an AI, not a person, both on this site and on (562) 620-3988.

AI can be wrong or incomplete. Tony's answers, and anything else our AI features produce, are general information only. Check anything important with us before you rely on it.

Tony doesn't make offers, quote prices or agree to anything on our behalf. Only a signed agreement with NeverMiss commits us to provide a service.

Calls with Tony are recorded and transcribed, as described in the Privacy Policy. Please don't share customer, health or payment details.

Text messaging terms

We run two text programs. Everything in this section applies to both unless it says otherwise.

Program 1: NeverMiss Leak Report

• What you get: one text with a link to your Leak Report, and replies if you text us back. If you also tick the separate, optional marketing box, you also get follow-ups and offers from NeverMiss about its AI systems, including a walkthrough of your report, sent using automated technology.
• How you opt in: on nevermisslb.com, after you see your Leak Report, you enter your mobile number and tick one or both boxes. Neither box is ticked for you, and neither is needed to see your report.
• How often: one message with your report link, plus replies to your texts. With the marketing box ticked, up to 4 messages per month.
• Message and data rates may apply. We do not charge you for messages; your carrier may.
• Consent is not a condition of purchase.
• To stop: reply STOP. To get help: reply HELP.

Program 2: call follow-up texts

• What you get: follow-up messages about a call you took part in — missed-call follow-ups, appointment confirmations and scheduled callbacks.
• How often: message frequency varies; it is conversational, not a broadcast. Expect only messages related to your own enquiry.
• Cost: message and data rates may apply. We do not charge you for messages; your carrier may.
• To stop: reply STOP. To get help: reply HELP.

Consent is obtained verbally during a live phone call with a member of our team — we ask directly whether we may send you a follow-up text, and we record your answer, the time, and who took it. You may also opt in by texting our number first. We do not buy lists, and we do not send messages to anyone who has not agreed.

How you opt out

Reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END or QUIT to any message. You will receive one confirmation that you have been unsubscribed, and then nothing further. Opting out is immediate and permanent, and it also cancels any message already scheduled. You can opt back in by replying START.

You can also opt out by telling us in any other reasonable way, for example by replying "stop texting me" or by emailing us.

When we send

Messages are sent between 8:00am and 9:00pm in your local time zone. A message that would fall outside that window is held until the window opens.

The one exception is the Leak Report text itself. Because you ask for it on the site, we send it straight away, at whatever time you ask.

Supported carriers and liability

Carriers are not liable for delayed or undelivered messages. Message delivery depends on your carrier and device, and we cannot guarantee it.

Privacy

See our Privacy Policy for full detail. In short:

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors who provide support services, such as customer service providers, is permitted. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Calls and recording

Calls to and from us may be recorded for quality and training. Where recording is active you are told at the start of the call. California is an all-party consent state; if you do not wish to be recorded, say so and we will stop recording or end the call. You can ask to be added to our permanent do-not-call list at any time, on any call.

Shareable reports

Each Leak Report has its own hard-to-guess link. Anyone you share it with can open it, so share it only with people you choose. The shared view never shows your name, your phone number or the note you typed. Report links expire 90 days after the report is created, and you can delete yours sooner, as the Privacy Policy explains.

Acceptable use

You agree to use the site and our services lawfully, to provide accurate information, and not to interfere with or attempt to gain unauthorized access to our systems. In particular, you agree not to:

• use bots, scripts or scrapers on the site, or submit fake or automated answers, reports or phone numbers;
• enter someone else's phone number, or sign anyone up for texts without their permission;
• try to overload the site or get around its limits;
• try to manipulate Tony, pull out its instructions, or get it to say something harmful or misleading;
• share other people's information without their consent, including customer, health or payment details;
• impersonate anyone, or use the site to break the law or harm anyone.

We may block access, or suspend or end service, for misuse.

Paying clients

Where you are a paying client, fees, billing period and payment terms are set out in your service agreement with us. These terms do not replace that agreement. If the two conflict, your service agreement applies.

Our content and marks

The NeverMiss name, the panther mark, this website and our materials are owned by NeverMissai LLC and may not be copied or reused without written permission. You may view the site, and view and share your own Leak Report, for your own use.

Other companies' names

Product names are trademarks of their respective owners; NeverMiss isn't affiliated with or endorsed by them.

We show these names only to identify tools our systems can connect to.

Third-party services

Parts of the site run on other companies' services, including Calendly for booking and, if you click Accept, Meta's ad tools. Their own terms and policies govern what they do, and we are not responsible for their services.

Disclaimer

To the extent the law allows, the site, the Leak Report and Tony are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement. We don't promise that the site will always be available or free of errors.

Limitation of liability

To the fullest extent permitted by law, NeverMissai LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site or our services.

Nothing in these terms limits or excludes liability for fraud, for willful injury, for gross negligence, for violations of law, or for anything else that cannot lawfully be limited or excluded, including under California Civil Code Section 1668. Nothing in these terms takes away rights you have as a consumer that cannot be waived.

For paying clients, your service agreement sets the limits on our liability for the services it covers.

Responsibility for misuse

If you use the site for a business, and your misuse of the site or breach of these terms leads to a claim against us, you agree to cover the reasonable losses and costs that result, to the extent the law allows.

Governing law and disputes

These terms are governed by the laws of the State of California.

Any lawsuit about the site, these terms or our services will be brought in the state or federal courts located in Los Angeles County, California, and you and we agree to those courts' jurisdiction. Either of us can still bring a qualifying claim in small claims court.

Before either of us files a lawsuit, the one with the claim will send the other a written notice that describes the claim and the outcome wanted, and we will both try in good faith to resolve it for 30 days. Send notices to us at Liamhawke2006@gmail.com. This step doesn't apply to small claims cases, to requests for urgent court orders, or where waiting would cause a legal deadline to pass.

Notice for California users

Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice. This site is provided by NeverMissai LLC, Long Beach, California, phone (562) 620-3988, email Liamhawke2006@gmail.com. There is no charge to use the site or its diagnostic. To resolve a complaint about the site, or to get more information about using it, contact us by email or phone.

The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Accessibility

If any part of the site doesn't work for you, see our Accessibility Statement or contact us, and we'll help you another way.

Changes to these terms

We may update these terms. The effective date at the top of this page shows when they last changed. Changes apply from that date and do not reach back to earlier use. Continuing to use the site or our services after a change means you accept the updated terms.

General

• If any part of these terms can't be enforced, the rest still applies.
• If we don't enforce a term straight away, we haven't given up the right to enforce it later.
• These terms, the Privacy Policy and any signed service agreement are the whole agreement between you and us about the site and our services.
• You may not transfer your rights under these terms. We may transfer ours to a successor of our business.
